In this data protection statement for application procedure it is explained how we handle your personal data and protect this data in application procedures.
This data protection statement shall only apply for personal data from applicants, potential candidates and our optional promotional activities. It does not apply for our employees, contractors or customers, or other personal data that we collect for other purposes.
The term “personal data”, as used here, includes information by which our applicants and potential candidates can be identified, regardless of whether we receive this data as part of an online application, by post or email or via another channel (e.g. professional employment agency). All incidental personal data within the scope of an application procedure shall be processed and used in accordance with the new EU General Data Protection Regulation.

What data do we collect?
If you submit an application to us, we shall request the customary personal data directly from you. The categories of personal data processed include in particular your basic information (such as first name, surname, name affixes, nationality and personnel number), contact details (such as private address, (mobile) phone number, email address) as well as the details for the entire application procedure (cover letter, certificates, reference letter, interviews, qualifications and previous employment).
If you have voluntarily communicated special categories of personal data (such as health information, religion, degree of disability) in the application letter or in the course of the application procedure, processing shall only take place if you have consented to this.
In general, your personal data shall be collected directly from you in the course of the hiring process. However, we shall potentially also request personal data about you from third parties, for example from employment agencies, your given references, from previous employers if this is permitted in accordance with the applicable EU General Data Protection Regulation.
In addition, we shall process personal data that we have properly acquired from publicly accessible sources (e.g. professional social networks such as Xing).
Are you obliged to provide your data?
As part of your application, you must provide that personal data which is required for carrying out the application procedure and assessment of suitability. Without this data, we shall not be in a position to carry out the application procedure or to make a decision on establishment of an employment relationship.
How do we collect your data?
If you send us your application documents via the contact form, your information from the form including the files that you attach there shall be stored by us for the purpose of processing your application and in case of follow-up questions.
Alternatively, you have the option to contact us via the email address provided [email protected]. In this case, the user’s personal data and data attachments submitted with the email shall be stored.
Other data shall be collected automatically by our IT systems when you visit the website. This is technical data in particular (e.g. about your internet browser, operating system or time that you access our website). For what purposes and on what legal basis is your data processed?
We shall process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) as well as all other relevant laws (e.g. BetrVG (Works Constitution Act), AGG (General Act on Equal Treatment), etc.).
Data processing is primarily used to carry out and handle the application procedure and to assess to what extent you are suitable for the position in question. Ultimately, processing of your application data is necessary for us to be able to decide on establishment of an employment relationship. The primary legal basis for this is Article 6 (1)(b) GDPR together with Section 26(1) BDSG. In addition, collective agreements (group, overall and works agreements) under Article 88(1) GDPR together with Section 26(4) BDSG-new as well as if applicable your separate consent under Article 6(1)(a), 7 GDPR together with Section 26(2) BDSG can be used as a provision for authorisation under data protection law.
The processing of special categories of personal data depends on your consent under Article 9(2)(a) GDPR together with Section 26(2) BDSG.
Your application data shall be treated confidentially at all times. Should we wish to process your personal data for a purpose other than those mentioned above, we shall inform you of this in advance.
We might wish to store your personal data in order to consider you for future positions. In this case we shall obtain your consent beforehand or after you have formally applied for an advertised position. Your participation in such application programmes is completely optional.

Who shall have access to your data?
At MENZEL Elektromotoren GmbH, only those persons and entities, which prepare the hiring decision for us, shall have access to your data (e.g. human resources department, specialist department, relevant decision-makers in the particular case) or who are involved by law in hiring (e.g. works council).
Data storage
During the application procedure, your data shall be stored with MENZEL Elektromotoren GmbH. Your personal data shall be erased by us six months after conclusion of the application procedure i.e. after final filling of the position or other completion of the application procedure.
This shall not apply if statutory provisions on erasure prevent this or further storage is necessary for purposes of evidence, e.g. in a proceeding under the AGG or if you have consented to longer storage.
If we conclude an employment relationship with you after the application procedure, the data that we have for implementing the employment relationship shall be transferred to the personnel administration system and processed there.
Security
We have implemented generally recognised technical and operational security standards to protect personal data against lost, misuse, alteration or destruction. Our security measures are continually revised according to technical advances.
Within MENZEL Elektromotoren GmbH, access to your data shall only be provided to those entities which require this data for an application procedure.
